Terms and Conditions for Accommodation Agreements

Scope of Application

Article 1

  1. This document (“Terms and Conditions”) describes the terms of accommodation agreements and related agreements (collectively “Accommodation Agreements”) concluded between Sky cucule (“the Hotel”) and the Guest (“the Guest”). Any items not stipulated in these Terms and Conditions shall be determined according to the laws of Japan or generally established custom.

  2. Notwithstanding the above, in cases where the Hotel accepts a special agreement, insofar as such special agreement does not violate the laws of Japan or generally established custom, such special agreement shall have precedence over these Terms and Conditions..

Requesting an Accommodation Agreement

Article 2

  1. When requesting an Accommodation Agreement with the Hotel, please provide the Hotel with the following information.

    1. Names of Guests

    2. Dates of stay and estimated time of arrival

    3. Accommodation fee

    4. Other items as specified by the Hotel

  2. If the Guest wishes to extend their stay beyond the dates specified in Paragraph 1 (2) above and has made such a request during their stay, the Hotel shall process such a request as an application for a new Accommodation Agreement at the time such request is made.  For children sharing a bed, one child per bed (up to a maximum of four children sharing) is possible, and children below five (5) years of age are eligible to share a bed.

Establishment of Accommodation Agreement

Article 3

  1. An Accommodation Agreement becomes effective when the Hotel approves the request described in Article 2 above. However, this shall not apply if it is proved that the Hotel did not approve the request.

  2. When an Accommodation Agreement is established as described in Paragraph 1 above, the Guest shall pay the Hotel a deposit not exceeding the basic accommodation fee for the indicated stay (for stays of three (3) days or over, equivalent to 3 days’ stay) by the date specified by the Hotel.

  3. The deposit shall, in the first instance, be applied to the final accommodation fee payable by the Guest, and in the event that a situation arises in which the provisions of Articles 6 and 18 apply, the deposit shall be applied first as a cancellation charge and secondly as compensation, with any remaining balance being returned at the time of payment of the charges pursuant to the provisions of Article 12.

  4. In the event that the deposit stipulated in Paragraph 2 above is not paid by the date specified by the Hotel in the same paragraph, the Accommodation Agreement shall cease to be valid. However, this shall only apply in the event that the Hotel has notified the Guest to that effect when specifying the date for payment of the deposit.

Special Agreement in Which Payment of the Deposit is Not Required

Article 4

  1. Notwithstanding the provisions of Paragraph 2 of the preceding article, there may be cases in which the Hotel concludes a Special Agreement, which does not require the payment of a deposit after an Accommodation Agreement has been established as detailed in said Paragraph.

  2. If the Hotel did not request payment of the deposit described in Paragraph 2 of the preceding article when accepting a request for an Accommodation Agreement, or did not specify a payment due date, said Accommodation Agreement will be treated as a Special Agreement as described in Paragraph 1 above.

Refusal to Conclude Accommodation Agreements

Article 5
In any of the following cases, the Hotel may decline to honor Accommodation Agreements.

  1. The request for accommodation is not made in accordance with these Terms and Conditions.

  2. The Hotel is fully booked and there are no rooms available.

  3. It is determined that there is a likelihood that the person seeking accommodation at the Hotel may act contrary to the provisions of the laws and regulations, public order, or good morals in connection with the accommodation.

  4. The person intending to stay at the Hotel is clearly infected with an infectious disease.

  5. When the person seeking accommodation engages in violent demands, or imposes a burden that exceeds the scope of what is considered rational.

  6. When it is not possible to provide accommodation, due to natural disaster, facility breakdown, or other unavoidable reason. 

  7. When the person intending to use the accommodation is determined by the Hotel to be in a state as mentioned in Article 5 of the Okinawa Prefectural Ordinance for Enforcement of the Hotel Business Act.

  8. The person intending to use the accommodation is intoxicated, or their speech or behavior is so abnormal that they are deemed to be likely to cause trouble. 

  9. The person intending to use the accommodation has, in addition to violence, threats and blackmail, etc., made violent demands or other coercive and unreasonable demands or actions.

  10. If any of the following items apply to the person intending to stay at the Hotel.
    a) Is an organized crime group (hereinafter referred to as “Organized Crime Group”), as prescribed in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No.77 of 1991), a person who is an organized crime group member (hereinafter referred to as “Organized Crime Group Member”) as prescribed in Article 2, Item 6 of the above-mentioned Act, or a semi-regular organized crime group member, a person affiliated with an organized crime group, or another type of anti-social force.
    b) IA juridical person or other body, the business activities of which are controlled by an organized crime group or organized crime group member(s).
    c) IA juridical person of which an executive officer is an organized crime group member.

  11. A person who has previously engaged in acts at the Hotel that correspond to under (3), (5), (7) or (8) of this Article.

Guest’s Right of Cancellation

Article 6

  1. A Guest may cancel Accommodation Agreements by notifying the Hotel.

  2. If a Guest cancel Accommodation Agreements, in whole or in part, for reasons attributable to the Guest, (excluding cases in which the Hotel requested payment of a deposit, specifying a payment date as stipulated in Article 3, Paragraph 2 above, and the Guest cancelled Accommodation Agreements before such payment was made), the Guest shall be liable for payment of a cancellation fee as specified in Table 1. However, in cases in which the Hotel has made a Special Agreement as provided for in Article 4, Paragraph 1 above, in responding to the provisions therein the obligation to pay a cancellation fee when the Guest cancels the Accommodation Agreements shall only apply in cases in which the Hotel has informed the Guest of such an obligation.

  3. If Guests do not arrive at the Hotel by 10:00 pm on the first day of reservation (or within two hours of the expected arrival time as notified by the Guest in advance) without notifying the Hotel, such a Guest’s Accommodation Agreement may be deemed to have been cancelled by the Guest, and dealt with accordingly.

  1. “%” indicates the percentage of the cancellation fee to the basic accommodation fee. 

  2. In the case that the number of days of the Accommodation Agreement is shortened, regardless of the number of days shortened a cancellation fee shall be charged equivalent to one day (the first day) of accommodation.

  3. In the case of cancellation of all or part of a stay on a reservation involving consecutive nights’ accommodation, a cancellation fee shall be charged for each night.

  4. In the case of the number of Guests on the reservation being partially cancelled, regardless of the number of Guests on the reservation, a cancellation fee shall be charged for each Guest whose reservation is cancelled.

Hotel’s Right of Cancellation

Article 7

  1. The Hotel may cancel Accommodation Agreements in the event of any of the following. The Hotel shall not bear any liability for damages accruing due to the cancellation of the Accommodation Agreements under the stipulations of this Article.

    1. When one of the items in Article 5 of these Terms and Conditions applies, or it is discovered during the Guest’s use of the Hotel that one or more of these items applies.

    2. When a Guest is found to have tampered with fire-prevention facilities, etc., or otherwise fails to comply with items prohibited under the Hotel’s rules of use (limited to those items required for fire prevention).

  2. If the Hotel cancels Accommodation Agreements as described above, the Hotel shall not charge the Guest for any accommodation services not yet provided.

Registration of Stay

Article 8

  1. The Guest shall register the following information at the front desk of the Hotel on the first day of their stay.
    1) Guest’s name, age, sex, address and occupation
    2) For foreign guests, national, passport number, port of entry and date of entry into Japan
    3) Expected date and time of departure
    4) Other items as specified by the Hotel

In the case that the Guest seeks to make payment stipulated in Article 12 of these Terms and Conditions using a method other than cash, such as traveler’s cheques, accommodation voucher, or credit card, etc., this chosen method should be presented at the time of registration as described in the preceding Paragraph.

Times of Use of Guest Suites

Article 9

  1. The time when the Guest can use the guest room of the Hotel shall be from 2 p.m. until 11 a.m. of the following day. However, in cases when the Guest stays for more than one night in succession, the Guest may use the guest room all day except on the day of arrival and the day of departure.

  2. Notwithstanding Paragraph 1 above, the Hotel may permit the use of the rooms outside the hours described in Paragraph 1 above. For details please inquire with the front desk.

Compliance with usage rules

Article 10

  1. When in the Hotel, the Guest shall comply with the rules of use as stipulated by the Hotel and displayed or provided in the Hotel.

Hours of Operation

Article 11

  1. The hours of operation of main Hotel facilities are as follows.

Service hours of the front desk and cashier, etc.

  1. Curfew: none

  2. Front-desk services: 7:00-24:00

  3. Telephone service: 7:00-24:00

The hours listed in Paragraph 1 above are subject to change when necessary or when due to unavoidable circumstances. In this case, the Hotel will take appropriate measures to notify guests thereof.

Payment

Article 12

  1. The breakdown of the accommodation fee to be paid by the Guest and its method of settlement shall be in accordance with rules set out by the Hotel.

  2. Payment of the accommodation fee as described in the preceding Paragraph, shall be made in cash or by a cash alternative payment method approved by the Hotel, including traveler’s cheques, accommodation voucher, and credit card, etc., and shall be made at the front desk at time of check-in, or at a time requested by the Hotel.

  3. Even in the case in which the Guest has not stayed at the Hotel at the Guest’s discretion after the Hotel provided a guest room and made it available for the Guest to use, the accommodation fee will still be charged.

Responsibilities of the Hotel

Article 13

  1. If the Hotel cause damage to the Guest due to fulfilment or non-fulfillment of the Accommodation Agreements, the Hotel shall compensate the Guest for such damage. However, the same shall not apply if such damage was caused by reasons not attributable to the Hotel.

  2. The Hotel has liability insurance in case of fire, etc.

Handling in Cases when the Hotel Cannot Provide the Contracted Accommodation

Article 14

  1.  If the Hotel cannot provide the Guest with the contracted rooms, the Hotel shall obtain the Guest’s understanding and arrange other accommodation facilities to provide rooms as close as possible to the originally agreed conditions.

  2.  If the Hotel is unable to arrange the provision of alternative accommodations as described in Paragraph 1 above, the Hotel shall pay the Guest compensation equivalent to the cancellation fee as damages. However, the same shall not apply if such damage was caused by reasons not attributable to the Hotel.

Handling of Deposited Items, etc.

Article 15

  1. The front desk does not store cash or valuables. The Guest should use the safe provided in the guest rooms, the use of which is at their own risk and responsibility.

  2. With regard to items, cash or valuables that the Guest has brought to the Hotel, but has not stored in the safe provided in the guest room, if these are lost or damaged, etc., due to intentional conduct attributable to the Hotel or negligence on the part of the Hotel, after discussion with the Guest concerning the damage incurred, the Hotel shall pay compensation. However, if the type and value of the items are not specified by the Guest in advance, the Hotel will compensate for any damage accruing up to 150,000 yen, except in the case of intentional actions, or gross negligence on the part of the Hotel.

  3. In the case of the following items, the Hotel shall not bear responsibility, even in the case of the loss or damage to the deposited items.

    1. In the event of force majeure, such as a natural disaster.

    2. In the event of a request from the relevant government or public office, due to the exercise of judicial power, etc., to seize the deposited items, or submit them as evidence.

    3. In the event of loss or damage caused by the illegal acts of a third party.

    4. Any other matters arising for reasons not attributable to the Hotel.

Storage of Guest Luggage and Personal Belongings

Article 16

  1. If the Guest’s luggage arrives at the Hotel ahead of the Guest, only in the case that the Hotel has agreed to do so in advance of the arrival of the luggage will the Hotel take responsibility for storing such luggage, and the Hotel shall hand it to the Guest at the front desk when they check in.

  2. In the event that the luggage or personal belongings of the Guest are left at the Hotel after the Guest has checked out, when the owner of said luggage or personal belongings is identified, the Hotel shall contact the owner and ascertain the owner’s wishes. However, in the event that no instructions are forthcoming from the owner, or the owner cannot be identified, the Hotel shall store the luggage/items for three months from date of discovery, after which time, if there is no request otherwise, it shall dispose of said luggage/items. 

  3. The responsibility of the Hotel with regard to the storage of the Guest’s luggage or personal belongings in the case of the preceding two paragraphs shall, in the case of Paragraph 1 conform to the provisions of Paragraph 2 of the preceding article, and in the case of Paragraph 2 confirm also to the provisions of Paragraph 2 of the preceding article.

Responsibilities Regarding Parking

Article 17

  1. When the Guest uses the Hotel’s parking facilities, the Hotel is merely the lender of a parking space; the Hotel is not liable for the care of the Guest’s vehicle, whether vehicle’s key is deposited in the care of the Hotel or not. However, if the Guest’s vehicle is damaged while the Hotel is managing parking facilities, either intentionally or due to negligence on the part of the Hotel, then the Hotel shall be liable for compensation of such damages.

Responsibilities of the Guest

Article 18

  1. In the event of damage to the Hotel due to the Guest’s intentional actions or negligence, the Guest shall provide compensation for damages to the Hotel.

Disclaimer

Article 19

  1. The use of computer communications from within the hotel is at the Guest’s own risk. The Hotel shall not be liable for any loss or damage incurred by the Guest as a result of any interruption of service due to system failure or any other reason during the use of computer communications. Moreover, in the case that damage is incurred by the Hotel or a third party due to acts during use of computer communications that are deemed to be inappropriate, such damage arising shall be duly compensated.

House Rules

In order to ensure that Guests can stay at the Hotel safely and comfortably, in accordance with Article 10 of the Terms and Conditions for Accommodation Agreements guests are requested to comply with the following House Rules. If guests do not comply with these rules, then in accordance with Article 7 of the Terms and Conditions it may be the case that the Accommodation Agreement and other related agreements are cancelled.

  1. Upon entering your room, please be sure to read the Terms and Conditions for Accommodation Agreements.

  2. Please do not bring the following items into the Hotel.

  • Animals or other general pets

  • Regardless of the above provision, it is possible to bring in guide dogs, mobility service dogs and hearing dogs, as stipulated in the Act on Assistance Dogs for Persons with Physical Disabilities. However, in cases in which there is a possibility that being accompanied by an assistance dog for persons with physical disabilities could result in severe damage to hotel facilities, the Hotel reserves the right to refuse entry to such dogs.

  • Items that create an unpleasant or unusual odor.

  • Any items in extraordinarily large quantities/volumes.

  • Explosives, volatile oils, and other combustible or flammable materials.

  • Firearms and swords, etc., the possession of which is prohibited.

  • Any other items that the Hotel considers to threaten safety or be inappropriate.

When using the terrace, please be quiet after 10:00 pm. The use of fireworks is dangerous and not permitted. Other general residents live on the floors below. You are requested to be considerate to residents, and not raise your voice, sing, or behave in a boisterous manner that may disturb others. 
 

Please refrain from using naked flames in places that are easily combustible, such as in bed. 
 

Please note that the Hotel will not be held responsible for any of the following matters on the Hotel’s premises or within the Hotel.

  • Accidents or theft within the Hotel premises (including the parking lot).

  • Accidents involving Guests or Guests and condominium residents.
     

Please do not cause inconvenience to the Hotel by using sleeping pills or other drugs.

Please do not move any of the hotel’s facilities or items to another location or otherwise alter their condition without consulting the Hotel.

 

In the event of damage, loss, or contamination of buildings, furniture, fixtures, or other items due to reasons other than force majeure, the Guest may be required to pay an amount commensurate to any damage in compensation. 

 

Guest rooms are not to be used for any purpose other than accommodation or eating and drinking, without the express permission of the Hotel.

 

We refuse to provide payment on behalf of the Guest for purchases, taxi charges, postage changes, or luggage shipment, etc.

 

Lost and found items will be handled in accordance with laws and regulations of Japan. 

 

During your stay please store any valuables, such as cash and precious metals, etc., in the safe provided (free of charge) in your room. If valuables are lost in any other location the Hotel will not be held liable.

 

When leaving your room be sure to lock the door. 

 

Please do not invite outside guests to your room without first informing and receiving the permission of the Hotel.

 

Minors (underage persons) may not stay on their own at the Hotel without having special permission to do so from their parent/guardian.
 

In the event that your planned length of stay changes, please inform a staff member at the front desk. If you plan on extending your say, you are requested to pay for the extended portion of your stay on the day of extension.

 

Payment of fees should be made at the front desk, using either cash, or a form of cash alternative payment approved by the Hotel, such as traveler’s cheque, accommodation voucher, or credit card, etc. Please note that payment with any kind of cheques other than traveler’s cheques is not accepted. 

 

Please note that public use/display without permission of photographs, etc., taken in the hotel for business purposes may result in legal action.

 

In the case of the Guest being involved with anti-social forces such as organized crime groups or related persons, as well as cases in which there is a risk of offending public order and good morals, at the point at which such a fact is discovered the Hotel will refuse to provide accommodation, even after an Accommodation Agreement has been concluded, and also if the accommodation is already in use.
